These Terms & Conditions ("Terms") govern your use of the GIVVBACK service operated by Right Now Services LLC ("we," "us," "our"). By using givvback.com or our SMS messaging program, you agree to these Terms.

1. GIVVBACK SMS Program

Program Name: GIVVBACK Notifications

Program Description: GIVVBACK sends transactional SMS messages to customers, vendors, and referrers regarding home-service jobs (e.g. job status, payment confirmation, vendor assignment, referral cashback, and donation acknowledgement).

Message Frequency: Message frequency varies based on your activity. Typical recipients receive between 1 and 10 messages per active job.

Message & Data Rates: Message and data rates may apply. Carrier charges depend on your mobile plan. GIVVBACK does not charge a fee for SMS messages.

Opt-In: You consent to receive SMS by checking the consent box on givvback.com when submitting a service request, registering an account, or by replying START to a GIVVBACK number.

Opt-Out (STOP): Reply STOP to any GIVVBACK SMS at any time to unsubscribe. After replying STOP, you will receive one final confirmation message and no further messages until you opt in again.

Help (HELP): Reply HELP to any GIVVBACK SMS for assistance, or contact us at hello@givvback.com.

Supported Carriers: AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost, MetroPCS, and most other US carriers. Carriers are not liable for delayed or undelivered messages.

2. Service Description

GIVVBACK is a neighbor-powered home-services referral platform. Customers request services, referrers earn cashback for connecting jobs, and vendors complete the work. A portion of each completed job goes to the Give Back Fund supporting local community causes.

3. Payments & Cashback

• Customers pay for services via Stripe Checkout (secured by Stripe, Inc.).
• Referrers may earn cashback per qualifying completed job, paid via Stripe Connect.
• Cashback is subject to verification and may be withheld in cases of suspected fraud.
• All payments are non-refundable except where required by law or as authorized by GIVVBACK.

4. Acceptable Use

You agree not to:

• Submit false or fraudulent job requests.
• Use GIVVBACK to harass, defraud, or harm other users or vendors.
• Reverse engineer, copy, or resell any portion of the GIVVBACK platform.

5. Limitation of Liability

GIVVBACK connects customers with independent third-party vendors. We are not liable for the quality of work performed by vendors, property damage, injuries, or any disputes arising between customers and vendors. Use of the service is at your own risk.

6. No-Circumvention Policy — Vendor & Customer Off-Platform Contact

Vendors agree that: phone numbers, email addresses, physical addresses, and other contact details discovered through GIVVBACK — whether obtained from job details, introduction emails, on-site visits, or any communication initiated by the platform — shall not be used to solicit, transact with, or complete work for a customer outside of GIVVBACK for a period of twelve (12) months after the initial introduction. This includes accepting cash, checks, Venmo/Zelle/CashApp, or any other off-platform payment for jobs originating from a GIVVBACK referral.

Customers agree that: once introduced to a vendor through GIVVBACK, they will use the platform to schedule work, receive quotes, and pay for services for a period of twelve (12) months. Customers agree not to solicit direct off-platform arrangements with vendors introduced through GIVVBACK.

Enforcement & Liquidated Damages. A violation of this section by either party will result in immediate suspension of the offending account and, at our sole discretion, imposition of liquidated damages equal to the greater of $500.00 USD or three (3) times the estimated platform fee that would have been payable had the transaction occurred through GIVVBACK. These damages compensate GIVVBACK for lost platform fees, verification costs, marketing spend, and administrative overhead of investigating the violation, and are agreed by the parties to be a reasonable estimate of actual damages that would otherwise be difficult to quantify.

Reporting a violation. If a vendor or customer solicits an off-platform arrangement, please report it immediately to support@givvback.com. Reports made in good faith are confidential. GIVVBACK reserves the right to review platform records, payment history, and communications to investigate suspected violations.

Repeated violations will result in permanent removal from the platform, forfeiture of all pending commissions or cashback, and referral to our attorneys for collection of unpaid liquidated damages plus reasonable attorney's fees.

7. Privacy

Your use of GIVVBACK is also governed by our Privacy Policy.

8. Changes to These Terms

We may revise these Terms at any time. Continued use of GIVVBACK after changes constitutes acceptance of the new Terms.
